Decision:

* That the application for a variation of the Premises Licence by Daniel Thwaites plc in respect of the Ark Tavern, Chesterfield Road, Brimington, Chesterfield, S43 1AD be granted subject to:

 

(a)      the conditions in the revised operating schedule submitted with the application;

 

(b)      the following additional conditions:

 

i.     where such a measure would not contravene fire safety measures, self-closing arms will be fitted to external doors and to internal lobby doors to assist in preventing the breakout of noise from the premises;

 

ii.      regular supervision of external areas will be undertaken when external areas are in use by a suitably qualified senior member of staff who will be nominated to undertake this responsibility each time the premises carries on licensable activities and documented and made available to an authorised officer upon request. If the nominated member of staff observes behaviour which may cause a nuisance to local residents or a breach of the licence conditions they will take appropriate action to remedy this. Any incident observed and the outcome will be documented and made available to an authorised officer upon request;

 

iii.    signs will be erected at public exits and in prominent positions at the premises advising customers that drinks are not permitted outside after 23:00 each evening;

 

iv.    whenever amplified regulated entertainment is hosted at the premises, the management will conduct regular assessments of the noise emanating from the premises. Where such assessments indicate that the level of noise may cause nuisance to local residents, the management will take action to remedy the level of noise. Said assessment will be documented and made available to an authorised officer upon request;

 

v.     any amplified regulated entertainment which takes place at the premises will be channelled through an appropriately installed and effectively operating noise limiter. The noise limiter will be calibrated in conjunction with the Council’s Environmental Health service to such a level that the noise does not cause a nuisance to any noise sensitive properties in the vicinity;

 

vi.    whenever the premises is hosting regulated entertainment, the windows and doors will be kept closed, except for the purposes of access and egress, and appropriately specified acoustic boards (chosen after liaison with the Council’s Environmental Health service) will be used to cover all windows;

 

vii.  persons under the age of 18 to not be permitted on the premises unless accompanied by an adult.

 

(necessary to prevent the licensing objective of prevention of public nuisance).
