Local Government Act - Exclusion of Public

To move that the public be excluded from the meeting for the following item of business under Section 100(A)(4) of the Local Government Act 1972 on the grounds that it involves the likely disclosure of exempt information as defined in Paragraph 7 of Part 1 of Schedule 12A of the Act and under Regulation 14(2) of the Licensing Act 2003 (Hearings) Regulations 2005.

Decision:

That the public be excluded from the meeting for the following item of business under Section 100(A)(4) of the Local Government Act 1972 on the grounds that it involved the likely disclosure of exempt information as defined in Paragraph 7 of Part 1 of Schedule 12A of the Act and under Regulation 14(2) of the Licensing Act 2003 (Hearings) Regulations 2005.

Application for a New Premises Licence by Kimley Williams in respect of The Miner's Arms, 1 Bamford Street, New Whittington, Chesterfield, S43 2BA. (LC170)

Decision:

* That the application for a New Premises Licence by Kimley Williams in respect of the Miners’ Arms, 1 Bamford Street, New Whittington, Chesterfield, S43 2BA be granted in accordance with the application subject to:

 

(a)     the relevant mandatory conditions

 

(b)     the conditions set out in the operating schedule submitted with the application but modified by including the following additional conditions (necessary to promote the licensing objective of prevention of public nuisance):

 

(i)           That the hours for all licensable activities be restricted to 10.00 to 23.00 Sunday – Thursday and 10.00 to 00.00 Friday – Saturday and non-standard timings for bank holidays, Christmas, New Year and British Summer Time (and not as stated in the application) with a premises closing time of 30 minutes later;

(ii)          That a noise limiter be fitted to any amplification equipment used at the premises the setting of which will be done under the supervision of officers from the Council’s Environmental Protection Team, to be implemented within 28 days;

(iii)        That the beer garden must not be used for the consumption of alcohol after 23.00 every day;

(iv)             That performance of live music (excluding solo artists) be limited to the area inside the premises to the left of the front entrance and that 21 days notice of any live music performance be provided to the licensing authority and displayed outside the premises.
