*The Committee considered the under-mentioned applications in light of reports by the Development Management and Conservation Manager

and resolved as follows:-

 

CHE/20/00761/RET - CHANGE OF USE TO FALCON BREEDING FACILITY AND ERECTION OF NATURAL PAIRS CHAMBER, SITING OF CARAVAN AND RAISED DECK FOR USE AS A SITE OFFICE/MESS FACILITY, INCUBATOR ROOM AND CAMERA ROOM (RETROSPECTIVE ELEMENTS) AND FOR THE PROPOSED ERECTION OF AN IMPRINT CHAMBER AND QUAIL BARN. INFORMATION RECEIVED 16.03.2021 INCLUDING REVISED RED LINE BOUNDARY. AMENDED PLANS RECEIVED 14.07.2021 SHOWING LOCATION OF PROPOSED SEWAGE TREATMENT TANK AND SOAKAWAY AT LAND NORTH OF GREGORY LANE, BRIMINGTON FOR MR HANCOCK

 

In accordance with Minute No. 299 (2001/2002) Mr Stephen Hartley (objector) addressed the meeting.

 

That the officer recommendation be upheld and the application be approved subject to the following conditions:-

 

Standard time frame – part retrospective

 

1.  The development hereby permitted shall be begun before the expiration of three years from the date of this permission.

 

In accordance with approved plans and documents

 

2.  The development hereby approved shall only be carried out in full accordance with the approved plans (listed below) with the exception of any approved non-material amendment. All external dimensions and elevational treatments shall be as shown on the approved plan/s (listed below).

 

·        Site Plan, drawing number F100 Revision C (dated 09.07.2021)

·        Static Caravan, drawing number F140 (Dated 16.03.2021)

·        Double imprint chambers, drawing number F130 (Dated 15.03.2021)

Activity levels in accordance with operational labour report

 

3.  The development shall be carried out in full accordance with the details as submitted and information contained within the revised operational labour report (revision A) received 14.07.2021.

 

No public opening

 

4.  The site shall not be open to the public at any time.

 

Number of employees

 

5.  There shall be no more than two persons employed at the site at anyone time.

 

Use of caravan

 

6.  The caravan shall be used as a site office/mess facility, incubator room and camera room only.

 

Landscape management and enhancement plan

 

7.  A landscape management and enhancement plan shall be submitted to the local planning authority within three months of the date of this decision and which shall include (but not limited to)

 

 i.        Hedgerow enhancements and new landscaping planting to all boundaries to screen the site

 

ii.Management plan for the hedgerow

 

iii.        Details of biodiversity enhancement measures including soft landscaping and additional hedgerow planting

 

Painting of fencing/buildings

 

8.  All existing fences and buildings on the site shall be painted dark green within 6 months of the date of this decision. Fences and buildings (all elevations) to be installed on site shall be installed dark green.

 

External lighting

 

9.  There shall be no external lighting install on site

 

Details of parking/turning arrangements

 

10. The parking and turning area as detailed in drawing ‘Site Plan, drawing number F100 Revision C’ shall be provided within 3 months of the date of this permission in accordance with the application drawing and which shall thereafter be maintained free from any impediment to its designated use for the life of the development.

 

No gates or barriers other than those on drawings and they shall open inwards

 

11. There shall be no gates or other barriers other than those shown on the application drawings and any gates shall open inwards only, unless otherwise agreed in writing by the Local Planning Authority

 

12. There shall be no discharge of surface waters via soakaways prior to the submission of sizing calculations and full details designed in accordance with BRE Digest 365 to ensure no flooding occurs during a 30 year design storm as a minimum to be submitted to the local planning authority for written approval and once approved shall thereafter be maintained for the life of the development

CHE/21/00367/FUL - PROPOSAL: INSTALLATION OF A NEW SHOPFRONT INCLUDING NEW ILLUMINATED SIGNAGE AND ENTRANCE DOORS, EXTERNAL REFRIGERATION, DOOR REPLACEMENT AND INTERNAL CHANGES, GENERAL CAR PARK WORKS AND NEW FENCE - RESUBMISSION OF CHE/21/00091/FUL AT HOLMEBROOK VALLEY FAMILY CENTRE, PROMISES DAY NURSERY, WARDGATE WAY, HOLME HALL, CHESTERFIELD FOR HERON FOODS LTD.

 

That the officer recommendation be upheld and the application be approved subject to the following conditions:-

 

1.  The development hereby permitted shall be begun before the  expiration of three years from the date of this permission.

 

2.  The development hereby approved shall only be carried out in full accordance with the approved plans (listed below) with the exception of any approved non-material amendment:

 

·        Location Plan

·        Existing Plan and Elevation

·        Proposed Plans and Elevations

·        Existing Site Plan

·        Proposed Site plan

 

3.  The premises, the subject of the application shall not be taken into use until space has been provided, laid out and constructed in accordance with the application drawings for the parking and manoeuvring of delivery vehicles and which shall thereafter be maintained throughout the life of the development available for use and free from any impediment to its designated use.

 

4.  Construction work shall only be carried out on site between 8:00am and 6:00pm Monday to Friday, 9:00am to 5:00pm on a Saturday and no work on a Sunday or Public Holiday.  The term "work" will also apply to the operation of plant, machinery and equipment.

 

5.  Prior to occupation of the development as a shop, a scheme including a programme of implementation and maintenance) to demonstrate a net measurable gain in biodiversity through the development, shall have been submitted to and approved in writing by the Local Planning Authority. The net measurable gain shall be implemented, retained and maintained thereafter in accordance with the scheme and programme so approved.

 

6.  Notwithstanding the provisions of the Town and Country Planning (Uses Classes) Order 1987, and The Town and Country Planning (General Permitted Development) (England) Order 2015 (or any Order revoking or re-enacting these Orders with or without modifications), the premises shall be used as a convenience store only and for no other purpose, including any other activity within the same class of the schedule to that Order.

CHE/21/00371/FUL - PROPOSAL: CONVERSION OF EXISTING DWELLING INTO 1 ONE BED FLAT AND 1 TWO BED FLAT at 109 CHESTERFIELD ROAD, STAVELEY, CHESTERFIELD FOR MR JACK MCGUINESS

 

That the officer recommendation be upheld and the application be approved subject to the following conditions:-

 

1.  The development hereby permitted shall be begun before the expiration of three years from the date of this permission.

 

2.  The development hereby approved shall only be carried out in full accordance with the approved plans: Site Location Plan (notwithstanding the site plan including the parking proposals), Existing Plans and Elevations, Proposed elevations and floor plans and biodiversity measures drawing (received 28th June 2021); with the exception of any approved non-material amendment.

 

3.  Within 2 months of the completion of the development hereby approved, the proposed biodiversity measures (1 bird box) shall be implemented on site. These measures shall be retained and maintained thereafter in accordance with the scheme so approved.

 

4.  Construction work shall only be carried out between the hours of 8:00 am to 6:00 pm Monday to Friday and 9:00 am to 5:00 pm on a Saturday. Construction work shall not be carried out on Sundays or Public Holidays. The term ‘construction work’ shall include mobile and fixed plant/machinery (e.g. generators) radios and the delivery of construction materials.

 

5.  The dwellings hereby approved shall not be occupied until the optional requirement for water consumption (110 litres use per person per day) in Part G of the Building Regulations has been complied with for the respective dwelling.

 

6.  A scheme for the provision of car parking for 2 parking spaces, shall be submitted to the Local Planning Authority for consideration. The scheme should avoid access direct to Chesterfield Road with a barrier to be provided to the frontage to Chesterfield Road and be designed such that vehicles can enter and leave Chesterfield Road in a forwards gear. The approved scheme shall be constructed prior to first occupation of the flats and be made permanently available for its use thereafter unless otherwise agreed in writing by the Local Planning Authority. The spaces shall be laid out and constructed with a solid bound material (not loose chippings) but which include sustainable drainage and which shall be maintained thereafter free from any impediment to its designated use.

 

7.  A residential charging point shall be provided for the flats with an IP65 rated domestic 13amp socket, directly wired to the consumer unit with 32 amp cable to an appropriate RCD. The socket shall be located where it can later be changed to a 32amp EVCP. Alternative provision to this specification must be approved in writing, by the local planning authority.

 

The electric vehicle charging points shall be provided in accordance with the stated criteria prior to occupation and shall be maintained for the life of the approved development.

 

8.  Prior to occupation of the flats hereby approved, on site facilities shall be provided within the curtilage of the site for the secure and weatherproof storage of 3 bicycles in accordance with details to have been submitted to and approved by the Local Planning Authority beforehand.  Such facilities shall be maintained thereafter.

 

9.   Prior to occupation of the development hereby approved details of facilities for the storage and collection of waste and refuse within the curtilage of the site shall be submitted to and approved by the Local Planning Authority.  Development shall be carried out and thereafter maintained in accordance with the approved details.
